An Arizona court ruled that an illegal alien charged with killing a 21-year-old Arizona man will not receive the death penalty because he had an "intellectual disability," according to Breitbart News.

Judge Michael Kemp made the ruling last month that Apolinar Altamirano, 34, was not eligible to face the death penalty because he only had a fifth-grade education and could not obtain higher learning because of where he grew up in Mexico. The judge also ruled that prosecutors in the case were not permitted to point out that Altamirano was an alien living illegally in the U.S. for more than 20 years.
