Virginia Del. Chris Hurst (D-Montgomery) was let go with only a warning after being pulled over Sunday on suspicion of driving while intoxicated.

According to the Richmond Times-Dispatch, Hurst was pulled over in Christiansburg around 2 a.m. and blew a 0.085% on the breathalyzer, which is over the legal limit of 0.08%. However, Hurst was released after passing several other field sobriety tests.

The Times-Dispatch also reports that even if the police had wanted to cite Hurst, they would not have been able to because of a provision in the Virginia Constitution that grants state delegates immunity during General Assembly sessions.
